Terms of Service
These Terms of Service govern your use of the hubzoid.com website, including its documentation, and describe how the Hubzoid open-source software and Hubzoid implementation services are governed. By using the website, you agree to these Terms. If you use the website on behalf of an organization, you confirm that you are authorized to accept these Terms for it.
Section 01
About these terms
In these Terms, "Hubzoid", "we", "us" and "our" mean Hubzoid, and "you" means the person or organization using the website. Hubzoid offers three things, and each is governed differently.
The website at hubzoid.com, including its documentation, is governed by these Terms.
The Hubzoid software is open source and is governed by the Apache License 2.0, as described in Open-source software.
Implementation services, in which we design, build, deploy and hand over internal agents for an organization, are governed by a separate written agreement, as described in Implementation services.
Our Privacy Policy at /legal/privacy, Cookie Policy at /legal/cookies and Acceptable Use Policy at /legal/aup also apply to your use of the website.
Section 02
Eligibility
You must be at least 18 years old and able to form a binding contract to use the website. The website and our services are intended for business and professional use.
Section 03
Using the website
We grant you a limited, non-exclusive, non-transferable and revocable right to access and use the website to learn about Hubzoid, read the documentation and contact us.
You may access the website with browsers and automated tools, provided that you do not impair its operation or availability or bypass measures that protect it.
Website content is provided for general information. It is not professional advice, and we may change it at any time. Descriptions of the software on the website do not form part of the Apache License 2.0 or of any agreement for implementation services.
When you submit a project request or contact us, you agree to provide accurate information and to share another person's details only if you are authorized to do so. Submitting a request does not oblige either party to enter into an agreement.
Section 04
Open-source software
Hubzoid is open-source software licensed under the Apache License 2.0. The source code is published at https://github.com/hubzoid/hubzoid. Your use, copying, modification and distribution of the software are governed by that license, and nothing in these Terms limits the rights it grants.
As the license states, the software is provided as is, without warranty of any kind. You run the software on infrastructure you choose and control. You are responsible for its configuration, security, operation and backups, for the model providers and other services you connect to it, and for complying with the laws that apply to your use.
Hubzoid does not host or operate self-hosted deployments and has no access to the data they process. The software includes third-party components that are distributed under their own licenses.
The Apache License 2.0 does not grant rights to the Hubzoid name, logo or other brand features. You may use the Hubzoid name to describe the origin of the software accurately or to state that your work is built with Hubzoid, provided that you do not suggest that Hubzoid endorses or is affiliated with you or your product.
Section 05
Contributions to the open-source project
Contributions to the open-source project are made under the Apache License 2.0, with the Developer Certificate of Origin sign-off described in the project's contributing guide. Your use of GitHub, including issues and pull requests, is governed by GitHub's terms.
Section 06
Implementation services
Implementation services are provided under a written agreement signed by Hubzoid and the customer, together with any order or statement of work made under it. That agreement sets out the scope, deliverables, fees, acceptance, warranties, confidentiality obligations and liability terms for the services. If the written agreement conflicts with these Terms, the written agreement prevails.
When we process personal data on a customer's behalf, the Data Processing Addendum at /legal/dpa applies. The Acceptable Use Policy at /legal/aup also applies to the services.
Unless the written agreement states otherwise, work created specifically for a customer, such as Hub context, agent instructions, tool configurations and operating documentation, belongs to the customer on handover. Hubzoid keeps its general know-how, methods and reusable components that are not specific to the customer. The Hubzoid software and other open-source components included in a deliverable remain subject to their own licenses.
Agents built in an engagement run in the customer's environment, using model providers and cloud services that the customer selects and contracts with directly.
Section 07
Acceptable use
You must use the website and our services in accordance with the Acceptable Use Policy at /legal/aup. Among other things, you must not use them for unlawful purposes, attempt to gain unauthorized access to our systems, interfere with the website's operation, or send spam or malicious content through our forms or email addresses.
Section 08
Intellectual property
Except for the open-source software and any content expressly made available under an open license, the website and its content, including text, graphics, illustrations, design and the Hubzoid name and logo, are owned by Hubzoid or its licensors and are protected by intellectual property laws.
You may view, download and print website pages for your own reference and quote short excerpts with attribution. You may not otherwise copy, modify, distribute or create derivative works from website content without our written permission.
Third-party names and logos shown on the website belong to their owners and are used to identify their products.
Section 09
Feedback
If you send us suggestions or other feedback about Hubzoid, you permit us to use it without restriction or payment. Please do not send confidential information as feedback. Contributions to the open-source project are covered by Contributions to the open-source project.
Section 10
Third-party services
The website links to, and the software works with, services provided by third parties, such as GitHub, the Python Package Index, model providers and the business tools you choose to connect. Those services are governed by their own terms and privacy policies. We are not responsible for them, and a link does not mean we endorse them.
Section 11
AI-generated output
Agents built with Hubzoid use AI models that generate output based on probabilities. Output can be inaccurate, incomplete or unsuitable for a particular purpose. You are responsible for reviewing output before relying on it and for the decisions you make using it, particularly where they affect other people.
Section 12
Disclaimers
To the fullest extent permitted by law, the website and its content are provided as is and as available, without warranties of any kind, whether express, implied or statutory, including warranties of merchantability, fitness for a particular purpose, title, non-infringement and accuracy. We do not warrant that the website will be uninterrupted, secure or free of errors.
The warranties that apply to implementation services are set out in the written agreement for those services.
Section 13
Limitation of liability
To the fullest extent permitted by law, Hubzoid will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising out of or relating to the website or these Terms, even if we have been advised of the possibility of those damages.
To the fullest extent permitted by law, Hubzoid's total liability for all claims arising out of or relating to the website or these Terms is limited to one hundred US dollars (USD 100).
Liability for implementation services is governed by the written agreement for those services. Nothing in these Terms limits liability that cannot be limited under applicable law.
Section 14
Indemnity
To the extent permitted by law, you will defend, indemnify and hold harmless Hubzoid against third-party claims, and the resulting losses and reasonable costs, arising from your breach of these Terms or the Acceptable Use Policy or your misuse of the website. Indemnities for implementation services are set out in the written agreement for those services.
Section 15
Suspension and termination
We may suspend or restrict access to the website, or to parts of it, if we reasonably believe you have breached these Terms or the Acceptable Use Policy, or where needed to protect the website, our users or others. You may stop using the website at any time.
Provisions that by their nature should continue after your use ends, including those on intellectual property, disclaimers, limitation of liability, indemnity and governing law, continue to apply. Ending your use of the website does not affect the rights you hold under the Apache License 2.0.
Section 16
Governing law and disputes
These Terms are governed by the laws of India. The courts of Bengaluru have exclusive jurisdiction over disputes arising out of or relating to these Terms or the website.
For implementation services, disputes are subject to the governing law and venue set in the written agreement. Where the agreement does not set a venue, the courts of Bengaluru have exclusive jurisdiction.
This section does not deprive you of any protection you have under the mandatory laws of the country where you live.
Section 17
Export controls and sanctions
You must comply with the export control and sanctions laws that apply to your download, use and distribution of the software and to your use of our services.
Section 18
Changes to these Terms
We may update these Terms from time to time. The date at the top shows when they were last updated. If we make material changes, we will post a notice on the website before they take effect. Your continued use of the website after changes take effect means you accept them. Changes to these Terms do not alter a signed written agreement.
Section 19
General
These Terms, together with the policies they refer to, are the entire agreement between you and Hubzoid about the website. If any provision is found unenforceable, the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver of it.
You may not assign your rights under these Terms without our consent. We may assign them in connection with a merger, acquisition or sale of assets. We are not liable for delays or failures caused by events beyond our reasonable control.
Section 20
Notices and contact
We may give notices by posting them on the website or, where we have your email address, by email. Send notices to Hubzoid by email to contact@hubzoid.com. For implementation services, notices are also sent to the address set out in the written agreement.
